DIYARBAKIR - Diyarbakir State Security Court (DGM) no: 1 rejected on Tuesday the requests for clearing off record of convictions of Necmettin Erbakan, the former leader of the banned Welfare Party (RP).
Mehmet Ener, the lawyer of Erbakan, requested the court to clear off his client's record of convictions and to acquit him in accordance with the amendment to Article 312 of Turkish Penal Code (TCK).
The court delegation said that the amendment to Article 312 of TCK still considered the act of inciting hatred and enmity among people by making religious and racial discrimination a crime.
The court decided to reject the request and said that Erbakan had had the right to apply to the Supreme Court of Appeal.
Erbakan was tried by Diyarbakir DGM no: 1 and sentenced to one year in prison.
The Supreme Court of Appeal approved verdict of Diyarbakir DGM.
