ANKARA - Supreme Court of Appeals Criminal Department no: 7 approved 2 years imprisonment sentence and 750 million Turkish liras (TL) of fine given to Fadil Akgunduz on charges of opposing to Capital Market Law, on Monday.
Supreme Court of Appeals Criminal Department no: 7 approved the decision taken by the Basic Criminal Court no: 2 in Istanbul's Bakirkoy district to sentence Akgunduz to 2 years in prison and 750 million TL in fine.
Akgunduz lost his adequacy of being elected as a deputy because he was sentenced to imprisonment more than one year.
According to Article 76 of the Constitution and Article 11 of the Parliamentary Election Law, those who are sentenced to imprisonment more than one year, cannot be elected as deputy.
Earlier, Akgunduz said that he would run for independent deputyship in the elections to be renewed in southeastern province of Siirt on February 9.
The Higher Election Board (YSK) will take the final decision about Akgunduz.
When Akgunduz was elected as an independent deputy from Siirt in the general elections on November 3, 2002, Supreme Court of Appeals Chief Prosecutor Sabih Kanadoglu sent the file of the Basic Criminal Court no: 2 in Istanbul's Bakirkoy district to the Parliament Speaker's Office and requested his political immunity to be lifted.
When the YSK decided to cancel the elections in Siirt, Akgunduz lost his deputyship.
Akgunduz was arrested and sent to the prison.
