ANKARA - The second European Union (EU) adjustment package envisaging changes in five laws in line with the constitutional amendments was submitted to the Parliament on Monday.
In the package, re-trial process will be allowed under the light of decisions taken by the European Court of Human Rights (ECHR).
With the change to be made in the the Code of Civil Procedure, the justice minister, Supreme Court of Appeals chief prosecutor, convict or representative of convict can request re-trial within a year, if the ECHR determined that the Convention for the Protection of Human Rights and Fundamental Freedoms or additional protocols are violated in a verdict. The request will be assessed by the Supreme Court of Appeals General Board. The board will reject the request, if it is not made in the given period.
The package adds a temporary article to the Higher Education Board (YOK) Law, and pardons disciplinary crimes.
Under the package, disciplinary punishments of students will be pardoned from the beginning of 2001-2002 academic year to the date when the law comes into effect.
Records of these punishments will be removed from the files of students. The imprisonment term from three months to six months which is given to those who set up relations with international associations and organizations without permission, or releasing statements without the decision of the executive board will be changed into fine from 1 billion Turkish liras (TL) to 3 billion TL.
