ANKARA (A.A) - 03.07.2002 - Ahmet Iyimaya, a True Path Party (DYP) deputy, prepared a constitutional amendment proposal which foresees to overthrow the prime minister and ministers who do not resign despite an illness that makes fulfillment of the duties impossible.
In his proposal which is opened to signature of MPs at the parliament, Iyimaya proposed to annex a paragraph to Article 109 of the Constitution.
This proposed paragraph is as follows:
''The prime minister or minister who does not resign despite an illness that prevents him/her from fulfilling his/her duties and whose condition is clarified with health reports by three separate medical faculties upon instructions of the President is removed from office. Principles about the issue are arranged by the law. Article 116 of the Constitution is implemented even if prime minister is removed from office due to an illness.''
Article 116 of the Constitution is as follows:
''In cases where the Council of Ministers fails to receive a vote of confidence under Article 110 or is compelled to resign by a vote of no-confidence under Articles 99 or 111, and if a new Council of Ministers cannot be formed by within forty-five days or the new Council of Ministers fails to receive a vote of confidence, the President of the Republic, in consultation with the Speaker of the Parliament, may call new elections.
If a new Council of Ministers cannot be formed within forty-five days of the resignation of the Prime Minister without being defeated by a vote of confidence, or also within forty-five days of elections for the Bureau of the Speaker of the newly elected Parliament, the President of the Republic may likewise, in consultation with the Speaker of the Parliament, call new elections.''
Iyimaya needs to collect 184 signatures to submit his proposal to the Parliament Speaker's Office.
