VIENNA - Peter Seda, the examining magistrate of the Vienna State Court, has found incomplete the file Turkey sent to Austria, to support the extradition demand of Alaattin Cakici, who is considered as the head of an organized crime, and asked for additional data and documents from Turkey, spokesman of the court Friedrich Forsthuber said on Thursday.
Forsthuber told A.A correspondent that Cakici would be interrogated and then the court would decide whether or not to extradite him to Turkey after Turkey sent Austria additional information.
Seda had asked for additional information and documents from Turkey since he had hesitations about how much of his imprisonment time Cakici had served in Turkey, Forsthuber said.
Asked if Seda had concerns that Cakýcý's trial is not fair, Forsthuber said, ''Turkey is a sovereign country. The Austrian magistrate doesn't think this way. The judge has asked for some additional documents and information from Turkey, taking into consideration some objections of Cakici during his interrogation.''
After Turkey sent requested information and documents, Cakici would again be brought before the court and the judge would decide whether or not to extradite him, Forsthuber said.
Forsthuber noted that the trial would be open to public but could not give any definite date for the hearing. He implied that the hearing could be held three or four weeks later.
The file prepared by the Turkish Justice Ministry was handed over to the Austrian Foreign Ministry. The Austrian Foreign Ministry later presented it to the Justice Ministry.
Cakici was arrested in Graz, Austria on July 14th.
