ANKARA - The Constitutional Court returned on Thursday to parliament a general assembly decision to send former State Minister and Deputy Prime Minister Husamettin Ozkan and former State Minister Recep Onal to the High Court, since it was not conform to judicial procedure.
Constitutional Court Deputy Chief Judge Hasim Kilic recalled that the parliament decided on June 15, 2004 to send Ozkan and Onal to the High Court for wrongdoing and abusing their authorities.
''The Constitutional Court unanimously decided to return it to the parliament since it was not conform to judicial procedure. There should have been separate voting for Ozkan and Onal. However, the decision was made as a result of a single vote,'' he said.
Upon a question, Kilic said that the Court did not consider the case ''acceptable''.
Ozkan and Onal were sent to the High Court to cause the ''Halk Bankasi'', a public bank, suffering financial loss by not taking necessary measures on time and allowing improper procedures to be carried out during their term in office.
The Constitutional Court will take up the decisions about former Prime Minister Mesut Yilmaz and former State Minister Gunes Taner, tomorrow.
