ANKARA - Supreme Court of Appeals Chief Prosecutor's Office rejected on Monday the request of Felicity Party (SP) leader Necmettin Erbakan who was sentenced to 2 years and 4 months in prison in the case known by the public opinion as ''lost trillion'', for correction of the decision.
The Chief Prosecutor's Office sent a document to the SP in which it asked exclusion of Erbakan from party membership and end of his role as party leader within 30 days.
The Office ruled that the Supreme Court of Appeals Criminal Department no: 11, which upheld the imprisonment sentence against Erbakan, had fulfilled all points claimed in Erbakan's request for correction of the decision, and there was not any uncertain points left.
Assessing Erbakan's objection claiming that the Constitutional Court should carry out the financial inspection of political parties, the Chief Prosecutor's Office said, ''the inspection is regarded with the legal body of a political party. It does not include crimes and actions committed by real persons.''
The process known as extraordinary legal remedy in the domestic law ended with the decision of the Supreme Court of Appeals Chief Prosecutor's Office.
Sending a document to the SP, the Chief Prosecutor's Office asked exclusion of Erbakan from party membership and end of his role as party leader within 30 days the latest.
The Article 11 of the Political Parties Law envisages that those who are convicted of forgery, could not become members of political parties.
After the Supreme Court of Appeals Criminal Department no: 11 upheld the imprisonment sentence given to Erbakan on charges of forgery, Erbakan's imprisonment sentence was postponed for a year in line with a report of the Ankara Numune Hospital saying that Erbakan's illnesses were vital.
The Chief Prosecutor's Office also rejected requests of the other nine suspects of the case for correction of the decision.
