ANKARA - The Constitutional Court has cancelled a law giving the finance minister the authority over budgets of institutions.
The verdict of the court was published in Thursday's Official Gazette.
Earlier, the Republican People's Party (CHP) filed a lawsuit at the Constitutional Court, and requested cancellation of the Article 13 of the law about changes in some laws and decrees having the force of law.
The relevant article says, "the finance minister is authorized to make transfers from budgets of institutions to the additional allocations of the Ministry of Finance."
The Constitutional Court ruled, "under the Constitution, the legislative authority belongs to the parliament on behalf of the Turkish nation, and this authority cannot be transferred. Accordingly, the law giving unlimited authorities to the finance minister is contrary to the Article 7 of the Constitution. Therefore, the relevant article of the law was cancelled."
