ANKARA - Reassociation Law which aims reassociation members of terrorist organizations and strengthening of social tranquility and solidarity went into force after being published in the Official Gazette on Tuesday.
The law aims reassociation of members of terrorist organizations which are formed to commit crime for political and ideological aims.
The law will be implemented for those who participated and did not participate the crimes of terrorist organizations among members of terrorist organizations who surrender without showing armed resistance or members who receded from the terrorist organization and who were captured. Those, who provided shelter to terrorist organization members by knowing their situation or who obtained equipment, weapon or ammunition or helped them by other ways will also benefit from the law.
While, those who participated in the highest level of organizations' management and directed the organization by being effective on the whole organization are taking place within the scope of law, those who rejected their previous statements before the judge before their sentence has not become certain or who stated that they do not want to benefit from the law and those who had benefited from ''repentance'' laws of previous years and who committed crimes that were included in those laws again are kept out of Reassociation law.
Those who did not participate in the crimes of terrorist organization and surrendered by themselves or by other ways without showing armed resistance after this law comes into effect or those who separated from organization and stated that they want to benefit from the law will not be punished.
If those, who are captured after validity date of law, state that they want to benefit from law and help for the dispersion or revealing of terrorist organization by giving information regarding the organization or prevent the crime that organization plan to commit by giving documents and information or personal efforts, they will benefit from the reduction of punishment.
If those people give the information before their sentence becomes certain, their life sentence will be turned to 16 years imprisonment and other sentences will be reduced one third.
Mentioned arrangements will be valid for six months after the law goes into force.
According to law, if statements which were released with bad will to benefit from law or the evidences were unfounded, perpetrator will be punished with imprisonment not less than five years and he will not benefit from the law.
Punishments, which were given for those who committed the crimes included in the law again during the periods foreseen in Turkish Penal Code (TCK) after benefiting from the reductions, will be increased with a half period.
Decisions regarding the reduction will also be implemented for those who provided shelter to terrorist organization members by knowing their situation or who obtained equipment, weapon or ammunition or helped them by other ways.
Those, who only show shelter to terrorist organization members or help by other ways and give food, will not be punished.
Interior Ministry will take every measures for the reassociation of those, who benefited from the law, without waiting for the decision of court and with necessary protection measures. Expenses regarding the implementation of protection measures will be provided from appropriation of Interior Ministry's budget.
During the research of the truth of information, prisoners and convicts can be taken from prison and execution institution with the decision of court upon the will of office that is carrying out the research and the request of prosecutor by also taking the consent of prisoner.
Detention period will be decided by court. Judge will listen prisoner and convict all the time before he gives decision. However this period will not exceed four days each time and 15 days under any condition.
Health state of prisoner and convict will be controlled with a report of doctor during departure and return to execution institution and prison.
Execution can be postponed if courts consider it necessary in cases that the law is implemented.
