DRAFT LAW ENVISAGING ABOLISHMENT OF DEATH PENALTY, APART FROM MOBILIZATION AND WARFARE, TO BE DISCUSSED IN NATIONAL DEFENSE COMMISSION ON THURSDAY
ANKARA - Draft law envisaging abolishment of death penalty in military law, apart from situations foreseen in the Constitution, will be discussed in Parliamentary National Defense Commission.
The draft brings an amendment to Military criminal code and the Code of Military Procedure. Death penalty is abolished within this scope apart from mobilization and continuation of warfare.
The penalty, which is extending from 24 years up to 30 years imprisonment terms, given to those who get involved in killing of his commander, is envisaged to be implemented as imprisonment terms of 15 years in case the attack results in injury.
Under the draft, in case the attack is made in mobilization, limits of the punishment will be increased. The punishment will be death sentence in case the victim dies, and life imprisonment in case the victim is injured.
Files of the convicts, who had been given death sentence on charges of crimes included within this scope before the law takes effect, will be taken up again.
Those who lead military rebellion will be sentenced to heavy imprisonment terms not less than 10 years.
With an amendment made to Code of Military Procedure, permission of military prosecutor's office is asked for search and seizure. Written permission of the chief will be taken in urgent cases; however, it will be presented to the approval of authorized military court within 24 hours.
Arrangements pertaining to custody period and informing relatives of the detainee will be adjusted with the Constitution with this amendment.
The draft is expected to be discussed in Justice Commission after Constitution Commission.
